Welcome to the Flat Fee MLS Co-Listing Service provided by Realty Net, LLC.

This agreement specifies the terms under which Right Choice Manufactured Home Sales (hereafter referred to as "Participating Dealer") will collaborate with Realty Net, LLC for the listing of manufactured homes located within parks (Chattel) on the Multiple Listing Service (MLS) for a flat fee.

Acceptance of Terms

By utilizing the Flat Fee MLS Co-Listing service for manufactured homes (Chattel) and submitting the order form, the Participating Dealer acknowledges, accepts, and agrees to comply with these Terms of Use. This commitment is key to a cooperative effort designed to protect all parties involved.

Service Overview

Realty Net, LLC offers a Flat Fee MLS Co-Listing service at a one-time fee of $299 per listing for manufactured homes (Chattel). This service includes the initial MLS listing of a manufactured home to facilitate its sale. Listings are created based on information provided by the Participating Dealer or the Home Owner.

Payment Terms

The Participating Dealer agrees to pay Realty Net, LLC a non-refundable fee of $299 upfront for each manufactured home listing. This fee is payable upon submission of the Co-Listing order form.

Participating Dealer Responsibilities

The Participating Dealer is responsible for all aspects of the transaction following the initial listing, including but not limited to:

Negotiating with potential buyers and other real estate agents.

Communicating with all involved parties, including the Home Owner, potential buyers, and their agents.

Ensuring compliance with all applicable laws, rules, and regulations governing the sale of manufactured homes (Chattel).

Indemnification

The Participating Dealer agrees to indemnify, defend, and hold harmless Realty Net, LLC, its affiliates, officers, agents, employees, and licensors against any claims, costs, expenses, judgments, damages, and liabilities, including reasonable attorneys' fees, resulting from the use of Realty Net, LLC's Co-Listing service, any transactions involving the sale of the manufactured home, or any breach of these Terms of Use.

Term and Termination

These Terms become effective upon acceptance by the Participating Dealer and remain valid until the sale of the listed manufactured home is completed, or until terminated by either party. Realty Net, LLC reserves the right to terminate this service at any time, without prior notice, for any breach of these Terms.

Governing Law

This agreement is governed by the laws of the State of Oregon, without regard to its conflict of law provisions.

Entire Agreement

These Terms constitute the full agreement between Realty Net, LLC and the Participating Dealer regarding the Co-Listing service for manufactured homes (Chattel), superseding all previous discussions or agreements.

Amendments

Realty Net, LLC reserves the right to modify these Terms at its discretion. Significant changes will be communicated to the Participating Dealer with at least 30 days' notice before implementation.

Acknowledgement

By submitting the Co-Listing order form for our Flat Fee MLS service for manufactured homes (Chattel), the Participating Dealer confirms having read, understood, and agreed to these Terms of Use.
